Terms & Conditions for Volcanic Shoots

 

These Terms and Conditions govern the use of our photography services, products, and this website. By booking or using any of our services, you agree to these terms.

 

Definitions

Client: The person or entity booking or using the services.

Photographer: Refers to Steven Simpson.

Session: Any photography event or shoot scheduled with us.

Product: Any physical or digital product delivered as part of our services, including prints.

 

Services Offered We offer professional photography services which include portraiture, event photography, etc.

 

Booking and Cancellation Policy

Booking: Payment in full is required at the time of booking to secure your session date.

Cancellation:

Cancellations made more than 2 weeks prior to the session date will receive a 60% refund of the payment made.

Cancellations within 2 weeks of the session date will not receive any refund.

No refunds are offered on prints as they are made to order and cannot be returned.

 

Payment Terms

All payments must be made at the time of booking.

We accept Zelle, Paypal, and all major credit cards.

Additional costs such as entry fees to locations, meals during sessions, or any other incidental expenses are to be borne by the Client.

 

Usage Rights and Copyright

All images are copyrighted to the Photographer unless otherwise specified by a separate agreement.

Clients are granted personal use rights for the images, but for commercial use, additional permissions or licensing fees may apply.

 

Image Delivery

Images will be delivered digitally via email to the email address provided by the client to the photographer within two weeks after the session, unless otherwise agreed upon.

 

Liability

The Photographer accepts no liability for any injury, loss, or damage to persons or property during the session, travel to/from session locations, or any related activities.

No insurance is provided or implied for any photoshoots or tours.

 

Privacy

Personal information provided by Clients will be used solely for the purpose of fulfilling the photography services and will be handled in accordance with our Privacy Policy.

 

Dispute Resolution

These Terms are governed by the laws of Hawaii, US. Any disputes must be resolved through mediation or arbitration in Kauai, HI.

 

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website.

 

Acceptance of Terms

By booking or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

 

Miscellaneous

Force Majeure: We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control.

Severability: If any term here is deemed invalid, it shall not affect the enforceability of the remaining terms.
